Vote set on 6-month Deerfield land use moratorium extension

Deerfield-Webb City Council will consider extending by six months the moratorium on certain land-use and zoning requests in Milton’s Deerfield area when it convenes Monday night.

This is one of several items on the agenda for the June 3 meeting, which will begin at 6 p.m. in City Hall’s Council Chambers (2006 Heritage Walk). Citizens can attend in-person or watch online at https://www.youtube.com/watch?v=jyBsWTfv8Ro.

As is customary for a Regular Meeting, the June 3 agenda is divided into distinct sections that have their own ground rules. For this meeting, they are:

  • The CONSENT AGENDA, which is where you’ll find routine items that the Council approves collectively (so a single yes-no vote covering the entire Consent Agenda)
  • PUBLIC HEARING, which is for certain types of items and includes a special opportunity for public comment
  • NEW BUSINESS, the home for items that are appearing on a Council agenda for the first time that can be discussed then voted on conclusively

Below are summaries of every item on the Monday meeting agenda.

 

CONSENT AGENDA

  • Approval of Meeting Minutes for the May 20, 2024, Regular City Council Meeting.

    The Council will vote on approving the “minutes,” or official written record, from its most recent meeting on May 20. At this meeting, an independent auditor gave the City’s financial documentation a “clean opinion,” crediting Milton with clearly presenting “materially correct” information and for going “above and beyond” what State law requires. The Council also approved a new firefighter/paramedic position that will cover for someone on an extended military deployment.   • Approval of the Financial Statements & Investment Report for the Period Ending April 30, 2024.

    Crabapple Road busy May 31 2024This is to approve the City of Milton government’s financial statements and investment report from this past April.

     

  • Approval of a Construction Services Agreement between the City of Milton and CMC, Inc. for the Construction of a Signalized Pedestrian Hybrid Beacon and Crossing on SR 372/Crabapple Road.

    With the approval of this item, crews from CMC will install a new pedestrian hybrid beacon signal, landscaped median islands, and crosswalk across Crabapple Road in Milton’s downtown. This will happen between the roundabout at Heritage Walk/Crabapple Chase Drive and the Broadwell Road/Birmingham Highway intersection as the first phase of the greater Crabapple Road streetscape project.   • Approval of Change Order #1 between the City of Milton and North Georgia Concrete, Inc. for Emergency Repairs at the New Bullpen Road Bridge.

    This change order is for North Georgia Concrete to do emergency repairs on a bridge at New Bullpen Road at the Cherokee County line. The work will consist of repouring concrete side structure beams and supports on the bridge, which was struck in a hit-and-run incident.

  • Approval of a Software as a Service (SaaS) Agreement and Addendum No. 1 Between the City of Milton and Tyler Technologies, Inc. for Use of the Munis ERP Software Solution.

    This item relates to an agreement with Tyler Technologies for a substantially upgraded Enterprise Resource Planning, or ERP, software that will be utilized by the City’s Finance Department (as well as potentially other departments). This more robust platform should improve workflow, efficiency, and enhanced reporting of the City’s financial information.

     

  • Approval of an Intent to Piggyback off Cooperative Procurement for Sourcewell Contract #101223-AXN and Milton’s Addendum No. 1 between the City of Milton and Axon Enterprise, Inc. for Public Safety Video Surveillance Solutions with Related Equipment, Software, and Accessories.

    This agenda item pertains to a contract for the Milton Police Department’s potential purchase from Axon Enterprises of in-car, body-worn, and interview room cameras. The agreement includes software, accessories, a records management system, as well as the related equipment.

     

  • Approval of a Change Order #1 to the Services Agreement between the City of Milton and Locality Media, Inc. dba First Due for the Addition of the Fire and Emergency Management Incident Command Package to the First Due Records Management System.

    The Milton Fire-Rescue Department uses First Due for its comprehensive records management system as well as responder and pre-incident plan data. With approval of this Change Order, the department will also utilize First Due’s new Incident Command package. This will allow incident commanders to track resources (firefighters, ambulance crews, apparatus, etc.) on a scene, toggling between the static preplan/GIS data and replacing the current system of whiteboards and paper. This information should seamlessly sync up with existing data that is already provided to Milton Fire through First Due.

     

  • Approval of a Request for Traffic Signal at SR 372/Crabapple Road at Green Road.

    The City has been coordinating extensively with the Georgia Department of Transportation (GDOT) on ways to address safety and congestion issues at the intersection of State Route 372/Crabapple Road and Green Road. Since that portion of Crabapple Road is a State Route, GDOT must approve any changes. Last December, the City contracted with Keck & Wood experts to create design plans for such a signal. Signal plans have been submitted and, for the process to move forward, the City must complete the signal application form request that is the subject of this City Council item. Such a signal would not preclude the possibility of other improvements (including a potential roundabout).

    PUBLIC HEARING

  • Consideration of the Issuance of an Alcohol Beverage License to Smoke on the Farm LLC dba Smoke on the Farm 12635 Crabapple Road, Suite 210, Milton, Georgia 30004.

    Smoke on the Farm is a new full-service restaurant in downtown Milton on the south side of Crabapple Road, near the intersection with Dunbrody Avenue. The applicant is seeking an alcohol beverage license to sell wine, malt beverages (i.e. beer), and spirits at this establishment, including on Sundays. The Public Hearing will be followed by a Council vote on whether or not to issue such a license.

     

     

    NEW BUSINESS

  • Consideration of a Resolution of the City of Milton, Georgia Extending for Six (6) Months an Existing Moratorium on Acceptance of Applications for Use Permits, Rezonings, Deerfield map zoningZoning Conditions Amendments, or Any Sort of Approval Considered a Zoning Decision by The Zoning Procedures Law for Property Within the Deerfield/Highway 9 Area.

    This spring, the City Council approved an emergency moratorium that prohibits the City from accepting new applications for use permits, rezonings, and zoning condition amendments that impact properties covered by the Deerfield Form Based Code. (Other types of permit requests can still be accepted and reviewed.) If the Council approves this resolution on the June 3 agenda, this moratorium would be extended by 6 months, thus ending on December 2. If this is not approved, the existing emergency moratorium would expire on June 3.

    This decision comes as the City embarks on a multi-faceted effort to create a Deerfield Implementation Plan focused on the future look, feel, and vitality of this important section of Milton.   • Consideration of a Resolution Authorizing Disposition of Fee Simple Right of Way to Abutting Property Owner WAKFAM Properties LLC at Providence Road East of SR 372/Birmingham Highway.

    New Providence Road City sale option3Earlier this spring, the Council approved a new policy outlining how to handle the potential sale of small or narrow strips of surplus City-owned land to adjacent property owners, so long as the requested area isn’t needed by the City, does not change the property’s use, and cannot be used independently. The tract related to this particular item is 0.04 acres, connects to the Providence Pointe subdivision, is by the Providence Road/Birmingham Highway roundabout, and serves no current use to the City. The City will sell this parcel with approval of this resolution.

      

  • Consideration of a Resolution of the Milton City Council Consenting to Expansion of the North Fulton Community Improvement District.

The North Fulton Community Improvement District – now known as True North 400 – is “a self-taxing business district committed to maintaining and enhancing the North Fulton community.” This organization has invested millions of its funds to advance more than $217 million worth of infrastructure projects in our area that enhance livability, walkability, and drivability.  As a member and municipality that works with True North 400, the City of Milton must approve any expansion of the properties that are part of this district in accordance with the law. That’s the purpose of this resolution, even though no Milton parcels are affected by this proposed expansion.
