Steps to buy 31+ acres, farm winery alcohol license on Council agenda

park acquisition overheadCity Council is set to consider Monday an alcohol beverage license request for a proposed farm winery and action toward the City’s potential acquisition of more than 30 acres on two sides of Milton.

Adopting a Unified Development Code and creating an ad hoc committee focused on active parks are also among items on the April 8 Council agenda. As is customary for a Regular Meeting, the agenda is split into distinct sections that have their own ground rules. They are:

 

  • The CONSENT AGENDA, which is where you’ll find routine items that the Council votes on collectively (so one vote covering multiple items)
  • REPORTS AND PRESENTATIONS, the home for proclamations, presentations, and reports during which Council may offer direction but not take votes
  • PUBLIC HEARING, which features a special public comment period for certain types of items
  • ZONING AGENDA, the place for zoning-related items that have appeared on previous agendas under First Presentation and can now be voted on
  • UNFINISHED BUSINESS, where you’ll find certain types of items that have been on past agendas (under First Presentation) that can be conclusively voted on
  • NEW BUSINESS, which is for items appearing on a Council agenda for the first time that can be discussed and decisively voted upon

 

Below are summaries of every item on the April 8 agenda.

 

CONSENT AGENDA

  • Approval of the March 18, 2024, Regular City Council Meeting Minutes.

    The City Council will vote on the “minutes,” or official written record, from when it last convened on March 18. During this meeting, the Council approved a revamped “branding toolkit” for Milton featuring a “flexible array of elements” that can used to present a cohesive, representative identity for the city, its character areas, and its government. There were also extensive public comments and a public hearing in Fiscal Year 2024 City budget amendments.   • Approval of the Financial Statements & Investment Report for the Period Ending February 29, 2024.

    The Council will vote on approving the City of Milton government’s financial statements and investment report for February 2024.

  • Approval of a Services Agreement with American Coach Lines of Atlanta, Inc., to Provide Bus Transportation for Milton Summer Camp Field Trips.

    The City’s Parks and Recreation Department directly runs two summer camps – Camp Compass and Camp Joyful Soles (the latter being a camp for special needs individuals between 13- and 22-years-old). While based in Milton facilities, participants in both camps will be bused to nearby locations to provide even more enriching experiences. With approval of the agreement on this agenda, American Coach Lines buses will be used for these “field trips.”

  • Approval of Task Order #2 with Columbia Engineering and Services, Inc. for Right of Way Acquisition Services at the Intersection of Webb Road and Cogburn Road.

    With approval of this task order, the City’s partners at Columbia Engineering and Services will oversee negotiations for right-of-way needed as part of an intersection improvement project at Webb Road and Cogburn Road.   • Approval of a Services Agreement between the City of Milton and Roof Technology Partners for a Roof Maintenance Plan at Milton City Hall, Fire Station 44, and Police Headquarters & Municipal Court.

    City Hall Green overheadThis is an agreement for Roof Technology Partners experts to conduct annual inspections and regular maintenance for the combination metal and TPO (Thermoplastic Polyolefin) roofs on City Hall, Fire Station 44, and the Milton Police Station/Municipal Court building.

  • Approval of a Recreation Provider Agreement Between the City of Milton and Market Share Inc. d/b/a Babysitter Bootcamp to Provide Babysitter Training Classes.

    With approval of this item, experts from Babysitter Bootcamp plan to partner with the Parks and Recreation Department to provide childcare training. This will include teaching people, particularly teenagers, what they should know when it comes to babysitting, ranging from emergency medical care to how to change a diaper.

  • Approval of a Recreation Provider Agreement Between the City of Milton and CandiNews Children’s Theater to Provide Recreational Theater Programming.

    This is another recreational program provider agreement, this one with Candinews Children’s Theatre. This group leads performance arts classes for children in several metro Atlanta cities, with Milton set to join them if this item is approved.

  • Approval of Subdivision Plats & Revisions.

    The Council will vote on revisions to three minor plats. They are:

  1. To split 4.973 acres at 16030 Birmingham Highway (north of New Bull Pen Road) into two separate lots.
  2. To combine 4 parcels that together are 2.091 acres at the intersection of Birmingham Highway and Providence Road, which will become home to Milton’s new Fire Station 45
  3. To combine two tracts at 16135 Lively Road in eastern Milton into a single 1.73-acre parcel

     

  • Approval of a Software as Service (SaaS) Agreement and Addendum No. 1 with Tyler Technologies, Inc. for Use of the ResourceX Priority Based Budgeting Platform.

With approval of this item, City staff will use ResourceX -- a budget module software with priority-based budgeting capabilities that was recently acquired by Tyler Technologies. This tool will supplement the department-based line-item budgeting approach the City has traditionally, and will continue, to use.

 

REPORTS AND PRESENTATIONS

  • Proclamation Recognizing the Milton Citizens Government Academy Graduates, 7th Cohort.

    Milton’s Citizen Government Academy immerses participants in all aspects of City government. Members CGA fire visitof each class of the CGA, as this is known, learn about every Milton department directly from those who lead them. They also visit City facilities, take part in interactive activities, ask questions and, more importantly, get answers that help make them more engaged, informed citizens.     Earlier this year, the seventh CGA cohort began their 8-week program. This group consisted of people with different backgrounds and interests, but a common passion for Milton. This agenda item is an opportunity to celebrate these CGA graduates, as well as hear from a representative speaker.

     

     

    PUBLIC HEARING

  • Consideration of the Issuance of an Alcohol Beverage License to Suite 200, LLC, 3000 Heritage Walk, Suite 201, Milton, Georgia 30004.

    The Council will consider issuing a new alcohol beverage license for Suite 200, a restaurant in the Market District in downtown Crabapple.

  • Consideration of the Issuance of an Alcohol Beverage License to D'Rose Vintners, 13555 Blakmaral Lane, Milton, GA 30004.

    This request for an alcohol beverage license is for a proposed new farm winery, D’Rose Vintners, on Blakmaral Lane. The Public Hearing is set to be followed by a Council vote.

     

    ZONING AGENDA

  • Consideration of RZ23-07 – A Text Amendment to Adopt a New Unified Development Code That Will Update and Replace the Current Zoning Ordinance (Chapter 64 of the Code for the City of Milton); to Readopt the Existing Zoning Map as Part of the New Unified Development Code; to Amend the Text of Other Specific Development, Design and Other Sections of the Code of the City of Milton, Georgia; To UDC.graphicConsolidate Said other Specific Sections as well as the Zoning Ordinance so as to Create a Consolidated Ordinance to be Known as the Unified Development Code for the City of Milton, Georgia.

    The City has been working to create a Unified Development Code, or UDC, for building and land development in Milton. The proposed UDC would not change any City rules, policies, or regulations related to these topics. Rather, it would collect all related code in a single place (rather than sprinkled throughout City Code) and present them in easier-to-understand language. 

    City leaders began discussing this effort in 2017. And Milton’s Planning Commission spent 18 months going through the draft UDC word-by-word, while the City Attorney’s Office also meticulously reviewed it. This matter has come before the City Council several times as well. You can learn more at www.miltonga.gov/UDC.

    This item had been on Council agendas earlier this year, only to be deferred so that the existing Official Zoning Map of the City of Milton could be adopted concurrently with the new UDC. Nothing about the draft UDC was altered between then and now. This latest item appeared under First Presentation at the Council’s March 18 meeting, so there can be a vote on adoption at Monday’s meeting.

     

    UNFINISHED BUSINESS

  • Consideration of an Ordinance to Amend Appendix A Fees and Other Charges of the Code of the City of Milton, Georgia to Reflect the New Code References Within the Newly Adopted Unified Development Code for the City of Milton, Georgia.
  • Consideration of an Ordinance to Amend Chapter 48 Streets, Sidewalks and Other Public Places of the Code of the City of Milton, Georgia in Order to Update and Relocate Certain Provisions into the Newly Adopted Unified Development Code For the City of Milton, Georgia.
  • Consideration of an Ordinance to Delete Chapter 20 Environment of the Code of the City of Milton, Georgia and to Relocate the Updated Provisions to the Newly Adopted Unified Development Code for the City of Milton, Georgia.
  • Consideration of an Ordinance to Delete Chapter 50 Subdivisions of the Code of the City of Milton, Georgia and to Relocate the Updated Provisions in the Newly Adopted Unified Development Code for the City of Milton.
  • Consideration of an Ordinance to Delete Chapter 54 Telecommunications of the Code of the City of Milton, Georgia and to Relocate the Updated Provisions in the Newly Adopted Unified Development Code for the City of Milton, Georgia.
  • Consideration of an Ordinance to Delete Chapter 60 Tree Canopy Conservation of the Code of the City of Milton, Georgia and to Relocate the Updated Provisions to the Newly Adopted Unified Development Code for the City of Milton, Georgia.

The six items above relate to a Unified Development Code for Milton, which is described earlier in this preview as part of the Zoning Agenda. One of the UDC’s primary aims is to streamline where corresponding items live in the City Code, making the framework and process cleaner, easier, and more consistent. These items all work toward that goal by making amendments and removing redundancies. They do not change the meaning or intent of any aspect of the City Code. 

 

  • Consideration of an Ordinance Creating the Milton Active Parks Ad Hoc Committee.

    City leaders have been discussing how to move forward to add active park space (with potential athletic fields, courts, etc.) in Milton. Approval of this ordinance would advance this process by creating a new ad hoc committee focused on active parks. This committee will assess the current inventory of City-owned land, determining if any should be transformed into active parks, as well as assess new opportunities for active field space.

    This advisory group will have seven members, including representatives from the Parks and Recreation Advisory Board, Milton Equestrian Committee, and Milton Greenspace Advisory Committee, as well as one at-large member selected by the City Council. As it appeared under First Presentation on the March 18 agenda, the Council could vote on the ordinance needed to create this committee on Monday.

     

  • Consideration of an Ordinance of the Mayor and Council of the City of Milton, Georgia, to Adopt Amendments to the Fiscal 2024 Budget for Each Fund of the City of Milton, Georgia Amending the Amounts Shown in Each Budget as Expenditures, Amending the Several Items of Revenue Appropriations, Prohibiting Expenditures to Exceed Appropriations and Prohibiting Expenditures to Exceed Actual Funding Available.

    As the City budget is a dynamic rather than static plan, it requires amending from time to time. The proposed budget amendments are an update to the Fiscal Year 2024 budget (which runs from October 1, 2023, to September 30, 2024). This Ordinance reflects recent changes recommended as a result of certain circumstances, opportunities, and recommendations. This item appeared under First Presentation, with a Public Hearing, on the City Council’s March 18 agenda, meaning it can be conclusively voted upon at Monday’s meeting.

     

    NEW BUSINESS

  • Consideration of a Resolution Appointing or Reappointing Members to the City of Milton Sustainability Advisory Committee by Appointing a Board Member for District 3/Post 2.

    The Milton Sustainability Advisory Committee (MSAC) is a new City board that will advise City leaders and staff on sustainability related matters, such as the creation of a Recycling and Solid Waste Management Plan. On Monday, the Council will consider appointing the newest member to MSAC from District 3/Post 2.

     

  • Consideration of Proposed Consent Final Order and Judgement to Settle Friendly Condemnation Action Re: Morris Road Widening Project, Parcel 10 (Owner: Morris Lake Townhome Association, Inc., Civil Action File No. 2023CV380045).

    This item, and corresponding vote, relates to an agreement between the City and a property owner to allow Milton to acquire a piece of land at the appraised value. This land is needed for the TSPLOST-funded Morris Road widening project, which you can find more about HERE: https://cleargov.com/georgia/fulton/city/milton/projects/1212/morris-road-improvements-_-tsplost.

     

  • Consideration of a Land Acquisition Agreement for Purchase of Realty Totaling 10.488 Acres, with a Purchase Price of $1,750,000 Between the City of Milton and 12875 Arnold Mill Road, LLC. for Two Land Parcels with Situs Addresses of: + Parcel 1 – approximately 7.338-acre parcel with situs address of 12875 Arnold Mill Road, with assigned tax parcel no. 22-3710-1093-056-7; and +Parcel 2 – approximately 3.15-acre parcel with situs address of 12912 New Providence Road (Rear), with assigned tax parcel no. 22-3700-1068-058-6

    The Council will vote on a land acquisition agreement for two adjacent properties, totaling 10.488 acres, off Arnold Mill Road and New Providence Road. The intent of acquiring these two properties in southwestern Milton (which are not far from Legacy Park) is for current and future City needs.

     

  • Consideration of a Resolution of The City of Milton Enacting an Emergency Moratorium on (1) the Acceptance of New Business License Applications for Entities that will Offer Consumable Hemp Products for Sale and (2) Acceptance of Applications for Development Permits, Building Permits, Rezonings, Zoning Condition Amendments, Variances, Use Permits, Warrants, or any other Permit or Permission that Would or Could Reasonably Result in the Retail Sale of Consumable Hemp Products in the City of Milton.

This resolution would enact an emergency moratorium on new business licenses for the sale of consumable hemp products as well as permits, rezonings, and other such permissions related to the sale of such products. If approved, it would extend through May 6, 2024.

 

  • Approval of Final Plat.

    The Ridge at Sweet Apple is a Brightwater Homes subdivision located off Ebenezer Road in southern Milton. The Council will vote on the final plat for this neighborhood, which (if approved) will consist of 19 single-family lots and 2.84-acres of common area and open space. The Ridge at Sweet Apple will also have a trail system that connects with adjacent Brightwater Homes’ neighborhoods.

     

  • Council Discussion of Letter of Intent (LOI) to Enter Into an Agreement for the Proposed Acquisition of 21.38 Acres Located at 300 Deerfield Parkway (Parcel 22 528010470262) at a Purchase Price of $8,000,000.

This relates to a letter of intent for the City to potentially purchase 21.38 acres at 300 Deerfield Parkway, which is between Webb Road and Morris Road.
